Terms and Conditions of Sale
These terms govern every order placed on www.sunuachat.com. By confirming your basket you accept them in full.
1. Purpose
These terms and conditions of sale (the “Terms”) set out the rights and obligations of SunuAchat and its customers for the online sale of fresh fruit, vegetables and farm produce delivered in Senegal.
They apply to every order placed on www.sunuachat.com, to the exclusion of any other conditions. SunuAchat may amend them at any time; the Terms that apply are those in force on the day the order is placed.
2. Seller identity
SunuAchat is the food marketplace of the Sunumbaye Leading Innovation group, a company incorporated under Senegalese law.

3. Products
The products offered are fresh farm goods sourced from partner farms approved by SunuAchat. Photographs and descriptions are indicative: as these are natural products, size, colour and ripeness may vary slightly from one delivery to the next.
Offers are valid while stocks and the day’s harvest last. If an item is unavailable, SunuAchat will offer an equivalent product or deduct the corresponding amount from the total due.
4. Prices
Prices are shown in CFA francs (XOF), all taxes included, excluding delivery charges. Delivery charges are displayed before the order is finally confirmed, according to the zone selected.
SunuAchat may change its prices at any time; the price applied is the one displayed when the order is confirmed.
5. Placing an order
An order is placed in four steps: choosing the products, checking the basket, entering contact and delivery details, then confirming.
Confirming the basket constitutes acceptance of these Terms. A summary is sent by email and by WhatsApp. The order is only definitively confirmed once our team has called or messaged you.
SunuAchat may refuse or cancel an order in the event of a previous dispute, a clearly incorrect address or an abnormal request.
6. Cash on delivery only
SunuAchat does not offer online payment. The site never requests, collects or stores any banking data: no card number, no account details.
Payment is made when the goods are handed over, directly to the delivery agent, in cash or by mobile transfer (Wave, Orange Money) as agreed during confirmation.
A receipt is issued with every delivery. If any site or message asks you for an online payment in the name of SunuAchat, it is an attempted fraud: report it immediately on +221 78 877 26 26.
7. Delivery
SunuAchat delivers in Dakar and its suburbs. Zones served, time slots and charges are detailed on the Delivery and zones page.
Stated lead times are indicative and run from confirmation of the order. A delay in delivery gives rise to neither cancellation of the sale nor damages, except in the event of gross negligence by SunuAchat.
The customer undertakes to be reachable on the number provided and to give access to the address supplied. If nobody is there, the delivery agent will make contact again; a second attempt may be charged.
8. Checking on receipt
Fresh products must be checked in the presence of the delivery agent. The customer verifies that the order is correct (items, quantity, condition) before paying.
Any product that is visibly damaged, crushed or non-compliant is taken back immediately and deducted from the amount due, or replaced on a future delivery, at the customer’s choice.
9. Claims, replacement and refund
Any claim about a defect not visible on receipt must be sent within 24 hours to contact@sunuachat.com or on +221 78 877 26 26, with a photograph where possible.
After verification, SunuAchat will replace the product on the next delivery or refund the corresponding amount, at the customer’s choice. Refunds are made through the same channel as the payment, within seven working days.
10. Right of withdrawal
The products sold on SunuAchat are perishable goods. In line with the practice applicable to such goods, they are not subject to a right of withdrawal after delivery.
However, any order may be cancelled free of charge as long as it has not been prepared: simply call or send a WhatsApp message to +221 78 877 26 26.
11. Liability
SunuAchat has an obligation of means regarding the proper functioning of the site and the quality of the products delivered. It cannot be held liable for poor storage of the products after delivery, nor for improper use.
SunuAchat is not liable for indirect losses such as loss of business or loss of opportunity.
12. Personal data
The data collected is used solely to process orders and provide customer service. It is never sold or transferred. Full details are set out in our privacy policy.
13. Intellectual property
The SunuAchat brand, the logo, the texts, the photographs and all elements of the site are protected. Any reproduction, even partial, is prohibited without prior written authorisation.
14. Force majeure
SunuAchat cannot be held liable for any failure resulting from an event of force majeure: bad weather, crop failure, prolonged power or internet outage, transport strike, administrative decision.
15. Governing law and disputes
These Terms are governed by Senegalese law. In the event of a disagreement, the parties will first seek an amicable solution. Failing agreement within thirty days, the dispute will be brought before the competent courts of Dakar.
